1. Who We Are and What This Policy Covers
Firefly Drone Systems, LLC, a Michigan limited liability company (“Firefly,” “we,” “us,” or “our”), with its principal office at 1900 Opdyke Ct, Auburn Hills, MI 48326, respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect personal information when you visit https://www.fireflydronesystems.com/ (the “Site”), submit an inquiry or pricing request, sign up for communications, apply for employment, or otherwise interact with us through the Site.
This Policy does not apply to information we collect offline or under a separately executed written agreement (such as an equipment sales agreement, lease, software-as-a-service agreement, end user license agreement, or training agreement), each of which is governed by its own terms, or to third-party websites and platforms that we do not operate.
2. Information We Collect
(a) Information you provide directly. When you submit our contact or pricing request form, we collect the information you choose to provide, such as your name, email address, phone number, company or organization, and the contents of your message. When you communicate with us by email or telephone, we collect the contents of those communications. If you sign up for marketing or newsletter communications, we collect your contact information and preferences. If you apply for a position through a careers page, we collect your name, contact information, resume, work history, and any other information you include with your application.
(b) Information collected automatically. When you use the Site, we and our service providers automatically collect certain technical information, such as your IP address, browser and device type, operating system, referring URLs, the pages you view, the dates and times of your visits, approximate location (such as city and region) derived from your IP address, and interactions with embedded media. This information is collected through cookies, log files, pixels, and similar technologies, as described in Section 5.
(c) Information from other sources. We may receive information about you from social media platforms when you interact with our profiles or content, from customers, partners, and referral sources, and from publicly available business sources.
The Site is not designed to collect sensitive personal information (such as government identification numbers, precise geolocation, health information, or financial account credentials), and we ask that you not submit sensitive personal information through the Site.
3. How We Use Personal Information
We use personal information to: respond to your inquiries and provide pricing and proposals; sell, lease, support, and train customers on drone show systems, hardware, software, and related products; issue invoices, process deposits and payments, and maintain business, tax, and accounting records (including through our accounting and invoicing platforms); send administrative and service communications; send marketing communications where permitted by law, which you may opt out of at any time; operate, secure, maintain, analyze, and improve the Site and our products; evaluate employment applications and administer our recruitment process; comply with legal and regulatory obligations, including tax, employment, and Federal Aviation Administration requirements; detect, investigate, and prevent fraud, security incidents, and misuse; establish, exercise, or defend legal claims and enforce our agreements and policies; and for any other purpose disclosed to you at the time of collection or with your consent.
4. How We Share Personal Information
We share personal information only as described below. We do not sell personal information, and we do not share personal information with third parties for cross-context behavioral advertising.
(a) Service providers. We share information with vendors that perform services on our behalf, such as website hosting and content management, analytics providers (for example, Google Analytics), video hosting and streaming, email and marketing platforms, customer relationship management tools, accounting, invoicing, and payment processing providers (for example, Intuit QuickBooks Online and associated payment processors), recruitment tools, and information technology and security providers. These providers are permitted to use personal information only to perform services for us.
(b) Professional advisors. We may share information with our lawyers, accountants, auditors, insurers, and similar advisors in connection with the professional services they provide to us.
(c) Legal, safety, and compliance. We may disclose information to comply with applicable law, regulation, subpoena, court order, or governmental or regulatory request (including requests from aviation authorities); to enforce our agreements and policies; and to protect the rights, property, safety, or security of Firefly, our customers, or others.
(d) Business transfers. If Firefly is involved in a merger, acquisition, financing, reorganization, or sale of all or a portion of its assets, personal information may be transferred as part of that transaction, subject to reasonable confidentiality protections.
(e) With your consent. We may share information for any other purpose disclosed to you with your consent.
5. Cookies, Analytics, and “Do Not Track”
We use cookies and similar technologies that are strictly necessary to operate the Site, as well as analytics and performance technologies that help us understand how visitors use the Site. When you visit the Site, we display a cookie banner regarding our use of analytics cookies. We use Google Analytics to collect and analyze usage information; you can learn how Google collects and processes data at google.com/policies/privacy/partners and can opt out of Google Analytics by installing Google’s opt-out browser add-on. Most browsers allow you to refuse or delete cookies through your browser settings; if you disable cookies, some features of the Site may not function properly. The Site does not currently respond to “Do Not Track” browser signals or Global Privacy Control signals.
6. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including to maintain business relationships and respond to inquiries, and for longer periods where retention is required or advisable for legal, tax, accounting, insurance, or dispute-resolution purposes. In determining retention periods, we consider the nature and sensitivity of the information, the purposes for which it was collected, applicable legal and regulatory requirements, and applicable statutes of limitation.
7. Data Security
We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and disclosure. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. If a security breach affecting your personal information occurs, we will notify you as required by applicable law, including the Michigan Identity Theft Protection Act.
8. Your Choices and Privacy Rights
(a) Marketing communications. You may opt out of marketing emails at any time by using the unsubscribe link included in each message or by contacting us using the information in Section 14. We will continue to send transactional and service communications related to your inquiries or engagements.
(b) Cookies. You can manage cookies through the Site’s cookie banner and through your browser settings as described in Section 5.
(c) Access, correction, and deletion. You may request access to, correction of, or deletion of the personal information we hold about you by contacting us at the address or email in Section 14. We will verify your request and respond within the time and in the manner required by applicable law. Certain information may be exempt from such requests, for example where we are required to retain it for legal, tax, or accounting purposes.
(d) State privacy rights. Depending on your state of residence, you may have additional rights under applicable state privacy laws, such as the rights to know, access, correct, delete, or obtain a portable copy of your personal information, and to opt out of targeted advertising, sales of personal information, or certain profiling, in each case to the extent those laws apply to Firefly. We will honor verified requests as required by applicable law, we will not discriminate against you for exercising your rights, and, where applicable law provides an appeal right, you may appeal a decision by replying to our response.
(e) California residents. California Civil Code Section 1798.83 (the “Shine the Light” law) permits California residents to request certain information regarding disclosure of personal information to third parties for their direct marketing purposes. Firefly does not disclose personal information to third parties for their direct marketing purposes.
(f) Authorized agents. Where applicable law permits, you may designate an authorized agent to submit a request on your behalf; we may require proof of the agent’s authority and verification of your identity.
9. Children’s Privacy
The Site is intended for business and professional audiences and is not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information through the Site, please contact us using the information in Section 14 and we will delete it as required by the Children’s Online Privacy Protection Act and other applicable law.
10. Visitors from Outside the United States
The Site is operated from the United States, and personal information collected through the Site is processed and stored in the United States, which may have data protection laws that differ from those of your jurisdiction. By using the Site or providing information to us, you understand that your information will be transferred to and processed in the United States as described in this Policy.
11. Third-Party Websites and Social Media
The Site contains links to third-party websites and social media platforms, including Instagram, TikTok, YouTube, and LinkedIn, and may link to affiliated or partner websites. This Policy does not apply to those third-party sites and platforms, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any third-party site you visit.
12. Job Applicants
Personal information submitted with an employment application is used to evaluate your candidacy, communicate with you about the recruitment process, verify information, and comply with applicable employment and record-keeping laws. Unless you request otherwise, we may retain application materials to consider you for future opportunities, subject to applicable law.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will post the revised Policy on the Site and update the “Last Updated” date above. If we make material changes, we will provide notice through the Site or by other reasonable means before the changes take effect. Your continued use of the Site after the effective date of a revised Policy constitutes your acknowledgment of the revised Policy to the extent permitted by law.
